It shall be the obligation of the buyer(s) to serve termination to the tenant(s), prior to September 1, 2012, if so desired.
It shall be the obligation of the buyer(s) to report to the Des Moines County FSA office and show filed deeds in order to receive the following if applicable: A. Allotted base acres. B. Future government programs.
Final base & tillable acres determined by FSA.
Buyer(s) shall cooperate by signing any needed paperwork at no additional cost to them in a 1031 exchange if the seller opts to do so.
All tracts are being surveyed by a registered land surveyor.
The septic system will be inspected prior to the auction and any repairs or maintenance will be the obligation of the seller. After closing any repairs or maintenance will be the obligation of the buyer.
It shall be the obligation of the buyer of Tract #3 to reimburse the seller for the remaining gas in the LP tank at the current rate on the day of closing.
This real estate is selling subject to any and all covenants, restrictions and easements of record, as well as all applicable zoning laws.
There is an easement for the Michigan-Wisconsin Pipe Line Company on both tracts.
The buyer(s) shall be responsible for installing his/her own entrances if needed or desired.
If one buyer purchases more than one tract the seller shall only be obligated to furnish one abstract and deed. (husband & wife constitute one buyer)
The buyer(s) shall be responsible for any fencing in accordance with Iowa state law.
If in the future a site clean up is required it shall be at the expense of the buyer(s).
