MANNER OF SALE: This property will be offered as a MULTI-PARCEL auction in 13 individual tracts. Tracts 1 through 12 will be offered in combination of the Buyers choices. Tract 13 will sell separately and will NOT be offered in combination with any other tracts. This property will be sold in the manner that produces the highest aggregate bid. There will be OPEN BIDDING on all tracts and combinations of Tracts 1-12 during the auction as determined by the auction company. Auction procedure and increments of bidding are at the discretion of the auction company.
TERMS: 10% down day of sale, with the balance to be paid on or before April 22, 2014, or upon such terms as may be acceptable to the Seller. Personal and corporate checks are acceptable for the down payment with the final payment to be made in certified funds. All funds will be held by the auction company in their trust account or by an identified title/escrow company. Bidding is not contingent upon financing. Financing, if necessary, needs to be arranged and approved prior to the auction. Announcements made day of sale will take precedence over printed material and previously made oral statements.
MINERAL RIGHTS: Seller will retain 25% of the mineral rights for a term of 10 years, or as long as production, if any, exists.
WIND LEASE: Most tracts are subject to Memorandums of Easement for Wind Energy Development with Santa Fe Wind Project, LLC. Future benefits under leases will go to Buyer(s).
CROPS: Tracts 1, 2, 5, 8, 9, 10, 11 & 12: Buyer(s) will receive the landlords 1/3rd share of the 2014 wheat crop and will be responsible for payment of spraying the open acres.
Tract 4: Tenant will retain 100% of the 2014 wheat crop. Buyer will receive the $6,000 cash lease payment for 2014, and will be responsible for payment of spraying the open acres.
FSA INFORMATION: FSA farm program payments associated with the 2014 crop year will be subject to the new Farm Bill provisions.
CRP: Buyer(s) will receive 100% of the 2014 CRP payments on Tracts 8,9,11 & 12.
CLOSING: Closing will be on or before April 22, 2014.
POSSESSION: Date of closing on the open acres and subject to the tenants rights on the 2014 wheat crop, except on Tract 4.
Tract 4: Buyer will receive possession after the 2014 wheat harvest on NE/4 with immediate possession of the corners. Buyer will receive immediate possession of the SW/4.
REAL ESTATE TAXES: Seller will pay taxes for all of 2013 and prior years. Taxes for 2014 will be the responsibility of the Buyer(s).
SURVEY: In the event the Tracts 1, 2, and 3 sell separately at the auction, Seller will provide a survey sufficient to convey title and provide title insurance to the Buyers.
ACREAGES: Acreage figures are considered to be approximate and are from reliable sources based on (USDA) FSA figures. All FSA information is subject to change, including but not limited to the number of cropland acres, grass acres, base acreages and yields. FSA acres may not be the same as deeded acres or county appraiser acres. Acreages are not covered by title insurance.
ACCEPTANCE OF BIDS: The successful bidders will be required to enter into a real estate purchase contract immediately following the auction. Copies of the contract will be available from the auction company prior to the sale.
EVIDENCE OF TITLE: Seller will provide title insurance to the Buyer(s) in the amount of the purchase price with the premium to be paid one-half by the Buyer(s) and one-half by the Seller. Title evidence will be provided on sale day.

TRACT 4 -- IRRIGATION INFORMATION
All irrigation equipment currently located on the property is included in the sale, including a 1980 towable Zimmatic sprinkler on the NE/4 of Section 32, except the 350 Chevy engine located on SW/4 of 32. The sprinkler is nozzled at 250 GPM.
There are three irrigation wells located on the property covered under Water Rights File ##s 13689 permitted for 170AF at 400 GPM, 13688 permitted for 150AF at 630 GPM, and 15540 permitted for 185AF at 650 GPM.
