Auction Terms and Conditions:
Auction date and time: Thursday, July 12th, 6:30 p. m.

4.) A Buyers Premium of 2% will be added to the high bid on each tract to determine actual contract price.
5.) The property will be offered two ways: 1) Each lot individually, and 2) The entire 15 lots as one unit. The property will be sold in the manner resulting in the highest total sale price.
6.) Cash to Seller at closing.
7.) Property sells without contingencies. Prospective Buyers must have their financial arrangements made prior to bidding.
8.) Buyer agrees to pay on auction day, non-refundable earnest money of $3,000 per tract. Personal or company check are acceptable methods of payment of earnest money. Earnest money will be deposited into the Auctioneers trust account and applied towards the Buyers purchase at closing.
9.) Successful bidder(s) will sign a Buy/Sell Agreement immediately following the auction.
10.) Seller will provide Buyer with Title Insurance.
11.) Property will transfer by Warranty Deed.
12.) All water rights (if any) transfer to Buyer(s) at closing.
13.) All mineral rights (if any) will transfer.
14.) Closing on or before Friday, August 17th, 2012.
15.) Possession will be at closing.
16.) Taxes will be prorated to the date of closing.
17.) Closing agent fee for each tract will be shared equally by the Seller and Buyer.
18.) Auctioneers are working as exclusive agent for the Seller.
