TERMS
1. Auction Company
This real estate auction is conducted by Landproz of Indiana, LLC (Auction Company).
2. Bidding Format
All bidding will be on a total dollar basis, unless otherwise indicated by the Auctioneer during the auction.
3. Acreage and Survey Adjustments
The property is being sold based on deeded acres, which are subject to change due to survey results or other factors. In the event of such change, the total sales price will be adjusted accordingly.
If the property is sold in individual tracts and a survey is required, the Seller will cover the cost of the survey.
A Landproz representative may place a marker flag where the boundary lines should be. This is not a final survey and is for viewing purposes only. The final survey points are subject to change prior to closing and any changes will be reflected in the final purchase agreement.
4. Closing Details
Closing will take place at: Ford Abstract in Greensburg, Indiana
Closing will occur on or about April 8, 2026.
Seller will provide a standard Owner's Title Insurance Policy at Sellers expense.
Buyer and Seller will split the Closing Fee equally.
2026 Real estate taxes will be prorated to the date of closing.
A maintenance agreement will be prepared on behalf of the Seller for drainage tile on Tracts 1, 3, and 4, and recorded at Closing, if any of these tracts are sold separately.
There will be a 2% Buyers Premium added to the final Purchase Price.
5. Deposit and Payment Terms
A 10% (non-refundable) earnest money deposit is due on each tract the day of the auction.
The balance of the purchase price is due at closing.
6. Bidder Eligibility and Conduct
The Seller and Auction Company reserve the right to accept or reject any and all bids at their sole discretion.
The Auction Company and Seller reserve the right to preclude any person from bidding if there is any concern regarding that persons credentials, qualifications, or ability to enter into a binding contract.
7. Contingencies
The sale is not contingent upon Buyers ability to obtain financing, conduct an inspection, complete an appraisal, or fulfill any other conditions.
All property is sold AS IS, WHERE IS with no warranties or guarantees expressed or implied.
8. Announcements
Any announcements made on the day of the auction by the Auctioneer will take precedence over any previously published or advertised material.
LandProz, and its representatives are exclusive agents of the Seller.
A 2026 Crop lease will be signed along with a Purchase Agreement at the conclusion of the auction between Buyer and Seller, from the day of the Auction to the day of Closing for a cost of $0, allowing the Buyer to have farming rights prior to Closing. If the Buyer is unable to Close, then the Seller reserves the rights of ownership to any planted crops, applied fertility, or improvements made to the property.
