It is incumbent upon buyer to verify the accuracy of the property lines and maps with Sedgwick County. Environmental Conditions:
Seller nor McCurdy Real Estate & Auction, provide any warranty or representation as to the environmental condition of the real estate. Seller does inform any potential buyer that the State of Kansas passed the Contaminated Property Redevelopment Act on May 9, 2016. The Act authorizes the Kansas Department of Health and Environment to issue Certificates of Environmental Release (CELR) to certain prospective buyers of contaminated property. All buyers should investigate whether the real estate they are interested in would be eligible for this program. There is a fee associated with this program and each buyer should properly investigate. Seller believes that the real estate that is located in the North Industrial Corridor (NIC) within the City of Wichita meets the requirements to obtain a CELR from the State of Kansas.
The contract will call for a closing on or before 45days from the date of the auction.
Buyer understands and agrees that Sellers timely removal of personal property from the premises shall not be a prerequisite to closing and that the personal property may be abandoned by Seller.
