AUCTION TERMS AND CONDITIONS
METHOD OF SALE: The property will be offered in 5 individual parcels, any combinations or as a total unit. The property will be sold in the manner resulting in the highest total sale price.
EARNEST DEPOSIT: A 10% down payment of the total contract purchase price is due immediately and may be in the form of personal check, business check, or cashiers check. The balance of the purchase price is due in certified funds at closing. Your earnest deposit is non-refundable there are no financing contingencies.
BROKER PARTICIPATION: A commission will be paid to any properly licensed Broker who registers a successful buyer according to the Broker Participation terms. Broker Registration forms are available from Theurer Auction/Realty and must be completed and returned no later than Wednesday, July 1st at 5pm.
CLOSING: Closing shall occur on or before August 14, 2015.
SURVEY: If needed, a survey will be performed to determine legal descriptions with Seller and Buyer(s) sharing the cost.
TITLE: Owners Title insurance shall be shared equally between Seller and Buyer.
POSSESSION: Possession of the cropland shall be given following harvest of 2015 milo crop. Possession of the grass and river area shall be at closing.
CROP SHARE: Buyer shall receive landowners 1/3 share of 2015 milo crop and equivalent FSA payment. Buyer shall pay landowners 1/3 share of fertilizer / chemical applied to 2015 milo crop.
TAXES: 2015 taxes shall be prorated to date of closing based on 2014 taxes and on number of acres purchased. Taxes for 2014 totaled $1,393.04.
MINERALS: Seller to retain 34% minerals, participating, for 20 years on land not currently leased (40 Acres in Tracts 2 & 3 and 120 Ac in Tracts 4 & 5).
Seller to retain 100% production of oil and gas from currently producing wells until production ceases. Seller also retains all rights to any and all currently existing disposal wells until permanent cessation of their use. Seller will retain all rights of ingress and egress, and operation of ancillary equipment necessary for operation of those well sites, including those granted to the oil and gas lessees under existing leases.
